The COMESA Competition Commission (CCC) has successfully held a two-day stakeholder validation workshop on the ‘Draft Reviewed COMESA Competition Regulations‘ in Lusaka, Zambia.
The CCC, a regional competition body established under Article 6 of the Regulations made under the COMESA Treaty, on 24 January 2024, published its Draft COMESA Competition and Consumer Protection Regulations (Draft Regulations), intended to repeal and replace the current COMESA Competition Regulations, 2004 (Current Regulations).
During the workshop, CCC CEO, Dr. Willard Mwemba, emphasised the need to produce a law that will facilitate business and ensure compliance.
The draft reviewed COMESA Competition Regulations are not meant for a single Member State but are a collective law for the entire Common Market.

The CCC’s goal is to better align the COMESA competition law with current market dynamics and developments since the current regulations were promulgated in 2004 (nine years before the CCC became operational).
The Draft Regulations introduce several important changes to competition law enforcement in the COMESA region.
Post-publication, the CCC sought public comments on the Draft Regulations culminating in the just-ended Stakeholders Validation Workshop after the 14 February 2024 comment submission deadline.
